Brian Wilson Fired While Tour Is Ongoing

The Beach Boys were excited to be together again when they reunited for this year's Grammy Awards for a 50th anniversary celebration, but that hasn't stopped controlling member Mike Love from giving Brian Wilson the axe, along with Al Jardine and David Marks. After sharing a stage again for an anniversary tour, Love announced he would be continuing the shows without his bandmates, and would instead play with Bruce Johnson and a backup band, which is rumored to include longtime Beach Boys friend John Stamos.

"The post-50th anniversary configuration will not include Brian Wilson, Al Jardine and David Marks. The 50th Reunion Tour was designed to be a set tour with a beginning and an end to mark a special 50-year milestone for the band," read a statement issued by Love.

The Boys have had their share of spats, drama, and addiction since forming half a century ago, but fans are shocked at the blatant disregard for sheer history and loyalty as founding members are forced out of their own show.

"I'm disappointed and can't understand why he (Love) doesn't want to tour with Al, David and me. We are out here having so much fun. After all, we are the real Beach Boys," Wilson said.

Sadly, the tour with Wilson, Jardine and Marks is still ongoing, meaning that if the hard feelings can't be overcome, London will be in for a strange set.

2:32PM EST September 29. 2012 - James Bond has never lost his license to thrill. The British secret agent has survived confrontations with countless megalomaniacs and femme fatales over the past 50 years. But more impressively, 007 survived changes in times and fashion, and kept audiences coming back for more.

Skyfall, the 23rd film in the spy franchise, opens in theaters Nov. 9, with Daniel Craig as Bond in the action thriller that also stars Ralph Fiennes and Javier Bardem. A new boxed set, Bond 50 (1962-2012, MGM, PG and PG-13, $200; Blu-ray, $300), celebrates a half-century of adrenaline rushes by collecting all 22 previous films in one place.

It's a sleek showcase for a series that has earned nearly $5 billion at the box office and had broad cultural impact with its cars, gadgetry, fashion, music and exotic locales. The films are arranged chronologically starting with 1962's Dr. No starring Sean Connery and ending with 2008's Quantum of Solace starring Craig. Nine are on Blu-ray for the first time — Goldeneye, Octopussy, The Spy Who Loved Me, You Only Live Twice, The Living Daylights, Tomorrow Never Dies, Diamonds are Forever, A View to a Kill and On Her Majesty's Secret Service.

Each film comes on a separate disc with several hours of bonus features (122 hours total) that include commentaries with cast and crew, photo galleries, theatrical trailers, TV and radio ads and other features. They are sleekly packaged in a matching set of hardcover books, which fit into a slipcase depicting the six Bonds striking deadly — though debonair — poses. Inside the books, the films' slots are marked by its year and seductive lead actress. An empty slot has been left for Skyfall.

A bonus disc has two new features — "The World of Bond," which looks at all the cars, women, villains, gadgets and music from the films; and "Being Bond" with reflections from Connery, George Lazenby, Roger Moore, Timothy Dalton, Pierce Brosnan and Craig on how they approached the character. The disc also includes videoblogs from Skyfall with cast interviews and a behind-the-scenes look at the making of the film.

James Bond is the creation of Ian Fleming, who worked for British naval intelligence during World War II, and based the character on people he knew in the service. He introduced Bond in 1953's Casino Royale and featured him in 12 novels and two short story collections before he died in 1964. Eon Productions, which was founded by Harry Saltzman and Albert R. "Cubby" Broccoli, made all of the movies in this set, Skyfall and a yet-unnamed 2014 film.

While most of the films have not been direct sequels to one another, several characters and conventions have provided continuity. Bond's boss, M, was played by Bernard Lee in the first 11 films and has been played by Judi Dench for the past seven. Desmond Llewelyn was a reliable source of humor as gadget master Q in 17 films and Lois Maxwell was loyal M secretary/Bond torch carrier Moneypenny in 14 films. Other characters (played by a variety of actors) who have made frequent appearances include Bond's CIA pal Felix Leiter and arch villain Ernst Stavro Blofeld (with the blue-eyed, white Turkish Angora on his lap).

The spy almost always introduces himself early in the film as "Bond, James Bond," he wrecks almost every exotic car (including the famed Aston Martin D85) Q provides him with and, of course, those martinis are "shaken, not stirred."

Hello and welcome to this Ethics Alert which will discuss the Proposed Advisory Opinion which was recently issued by the Professional Ethics Committee of The Florida Bar which found that that offering and recommending plea where defendant waives ineffective assistance and prosecutorial misconduct claims is unethical.  The link to the proposed advisory opinion is here:  Florida Bar Proposed Ethics Advisory Opinion 12-1.

The Professional Ethics Committee of The Florida Bar (PEC) met on June 22, 2012 and approved Proposed Advisory Opinion 12-1 regarding the ethical propriety of waivers of ineffective assistance of counsel and prosecutorial misconduct in criminal pleas.  The PEC considered the issue after a Florida lawyer requested an opinion.  The opinion initially notes that whether a particular plea agreement is lawful, enforceable and meet constitutional requirements is a legal question outside the scope of an ethics opinion; however, after reviewing the ethics issues, the PEC agreed with the majority of states which have found that it is improper for the prosecutor to make such an offer and for the defense lawyer to advise the client on accepting such an offer.

The opinion refers to Florida Bar Rule 4-1.8(h) regarding agreements limiting a lawyer's liability for malpractice which states: "(h) Limiting Liability for Malpractice. A lawyer shall not make an agreement prospectively limiting the lawyer's liability to a client for malpractice unless permitted by law and the client is independently represented in making the agreement.  A lawyer shall not settle a claim for such liability with an unrepresented client or former client without first advising that person in writing that independent representation is appropriate in connection therewith."

According to the opinion, since this plea agreement is between the prosecutor and the defendant and an ineffective assistance of counsel claim is not a malpractice claim, on its face, Bar Rule 4-1.8(h) does not prohibit advising a criminal defense client to enter a plea agreement that waives the client's right  to claim ineffective assistance of counsel in a collateral proceeding; however, "a lawyer should not be permitted to do indirectly what the lawyer cannot do directly" and a defense lawyer's recommendation that a client waive ineffective assistance claims is analogous to limiting malpractice liability, which is prohibited unless the requirements of this rule are met (i.e. the client is independently represented in making the agreement and/or the lawyer advises the person in writing that independent representation is appropriate in connection therewith).

In addition, unlike malpractice liability, which is a type of conflict that may be waived under specific circumstances with independent representation, the opinion found that the personal conflict created by such a plea agreement cannot be waived because of the adverse interests that it creates.  In concluding that a defense lawyer has a personal conflict of interest when advising a client a potential waiver of the right collateral proceedings regarding ineffective assistance of counsel and also a personal interest in not having the lawyer's own representation of the client determined to be ineffective under constitutional standards. the opinion quoted Rule 4-1.7(a)(2), which provides as follows:  "(a) Representing Adverse Interests.  Except as provided in subdivision (b), a  lawyer shall not represent a client if: *** (2) there is a substantial risk that the representation of 1 or more clients will be materially limited by the lawyer's responsibilities to another client, a former client or a third person or by a personal interest of the lawyer."

According to the opinion, this conflict is also not one in which the client should be asked to waive and pointed to the comment to Rule 4-1.7 which states that: "when a disinterested lawyer would conclude that the client should not agree to the representation under the circumstances, the lawyer involved cannot properly ask for such agreement or provide representation on the basis of the client's consent."  Further, a disinterested lawyer would be unlikely to conclude that the criminal defense lawyer could give objective advice about that lawyer's own performance.

With regard to the prosecutor's conduct in offering the plea agreement, the opinion aligns Florida with other states which have found that such an offer is prejudicial to the administration of justice and also assists the criminal defense lawyer to potentially violate Rule 4-8.4(d) and 4-8.4(a), Rules Regulating The Florida Bar.  The opinion states that the committee believed that the vast majority of prosecutors act in good faith and would not intentionally commit misconduct; however, some prosecutorial misconduct can occur unintentionally and (in the rare instance) even intentionally.  Also, the existence of prosecutorial misconduct may be known only to the prosecutor, such as when the prosecutor has failed to disclose exculpatory information.  The opinion states that it is prejudicial to the administration of justice for a prosecutor to require the criminal defendant to waive claims of prosecutorial misconduct when the prosecutor is in the best position (and may be the only person) who is aware that misconduct has taken place.

According to the Bar's notice, comments from Florida Bar members on the proposed opinion are solicited and the PEC will consider any comments received at a meeting scheduled for 9:30 a.m. on Friday, September 21, 2012 at the Buena Vista Palace in Orlando in conjunction with The Florida Bar's Midyear Meeting.  Any comments must contain the proposed advisory opinion number and clearly state the issues for the committee to consider.  A written argument may be included explaining why the Florida Bar member believes the PEC's opinion is either correct or incorrect and may contain citations to relevant authorities and comments should be submitted to Elizabeth Clark Tarbert, Ethics Counsel, The Florida Bar, 651 E. Jefferson Street, Tallahassee 32399-2300, and must be postmarked no later than August 14, 2012.

Bottom line:  As many of you know, I am a current member of the PEC which considered this opinion, although (much to my chagrin) I was unable to attend the September 22, 2012 meeting.  This was (and continues to be) a hotly debated and contested ethics issue and, if you are interested, I would encourage you to comment on this proposed PEC advisory opinion.

Apple is taking a lot of flak at the moment with the new Maps application. Replacing Google Maps in iOS 6 looks to have backfired if you're to believe the media. After all, this is a digital wound, and if it bleeds it leads. The moment will pass, and when it does, Apple will be in a far healthier position than if they had renewed their mapping deal with Google.

I want to stress one thing though. In all the coverage, one idea many are voicing is that Steve Jobs would not have released Maps for iOS 6 in the current condition. That's wrong. Not only would Steve Jobs have released Maps, he would have demanded it.

Let's be clear, Steve Jobs has made mistakes before with iPhone and iOS. Take the issues around the iPhone 4′s antennae, which if held incorrectly would decrease the effectiveness of the cellular radio. They happened on his watch. That was an issue that should have been caught in quality control. How about MobileMe, which was launched to great fanfare, which it followed up with by failing rather spectacularly.

Both of these issues made it out of Cupertino and into the hands of the consumer. Just as the new Apple powered version of Maps has done.

Here's the thing, Steve Jobs missed some showstoppers in his time, but he was also a risk taker who always played to win the long game. Launching iOS Maps now is a risk, but it is a necessary one for Tim Cook to play that long game.

One of Apple's biggest historical risks, at least in the eyes of the media, was the cancellation of the iPod Mini. It was Apple's number one product, it was the world's best-selling MP3 player, and overnight it was taken away. Something was in the wings (the solid-state iPod Nano), but at the time the decision was regarded as a short-term error. In the long-term you have to say it was the right decision.

When the iPhone launched, it was incomplete. Data was only available over GPRS/EDGE competing devices were already using 3G. It lacked basic functionality such as copy and paste, the ability to send and receive MMS's, and it would not allow third-party apps to run using native code. It would improve over time, but Apple had put everyone on notice, and they started to work on long game. Now, the new iPhone 5 can draw a direct evolutionary path to that original design.

I believe that the principle of launching early and iterating in public is exactly what is driving the decision behind iOS Maps. It's not perfect at the moment, but keeping the software under wraps would not improve it or make for a better out-the-box experience in six months time. If it was not launched this week, when should it be launched? Apple's data set will not improve until it is in the hands of the public.

Mapping is not just about presenting the basic data that you can bring in from TomTom, Google, NAVTEQ, or any other geo-data company. It's about keeping all the data up to date, it's about taking user data points to correct the existing data. It's about interfacing the map with location databases, company directories, personal experiences, and moments from social media. It's about feeding the data set with as much data as you can collect. Data that enriches the entire experience for everyone. Data that is fed back to the users.

The result is a modern and mobile search engine. That's the long game right there. It's less about giving Google a place in the iOS ecosystem, it's about ensuring that Apple has its own data set that millions of people will search on every day. As we move from desktop to mobile, habits change. The primary search box is not on a web page, the primary search box is on a map. Apple wants to control the search box in their own operating system, and that means taking full and autonomous control of the mapping experience.

That's why Google had to go. That's why Apple has decided to build their own mapping environment from the ground up. They want to be in control of one of the key touchstones of modern life. And if there was one mantra that Steve Jobs believed in, it was that Apple had to be in control of their own destiny.

Would Jobs have dumped Google Maps and released Apple's own Maps application in iOS 6? Even if he knew that the data was incomplete, and the media would have a field day? Knowing that the only way to improve it was through millions of iPhone users working with the Maps application every day?

Yes. Of course he would have released Maps.

It's just that Steve Jobs might have presented the rough edges a little bit better.

A promising teenage footballer described as a "role model" for his community may have been murdered in a fight over a girl in Brixton.

Junior Nkwelle, 15, was stabbed to death outside a block of flats and one theory was he may have been attacked by a jealous boyfriend.

Officers were called to reports of a disturbance on the Loughborough Estate just before 9.25pm on Thursday and found the boy with serious stab wounds. He was pronounced dead at the scene and police said the killing was not believed to be gang-related. A 14-year-old girl has been arrested on suspicion of murder.

Locals were shocked by the death as they gathered to inspect floral tributes placed outside Secker House in Minet Road.

One card on a tribute said: "Dear Junior, You was a good friend, a great footballer and a great person. Justice will happen. I promise!" Another said: "If football be the food of love 'Play on'. RIP young fella."

Solomon Smith, 27, a youth support worker at Marcus Lipton Youth Centre a few yards from the scene, said: "He was one of our locals, and had been coming here for about two years. He was a very good footballer. When he came in, he always played football indoors here. He was a very quiet guy, you wouldn't think anything like this would happen to him."

A Metropolitan Police spokesman said the dead boy was from the Loughborough Estate and that his next of kin had been informed.

A post-mortem examination was being carried out on Friday night at Greenwich mortuary with the results expected to be known on Saturday, the spokesman added.

Lambeth-based detectives, together with officers from the homicide and serious crime command, are investigating.

Nakoula Basseley Nakoula, 55, has been under investigation by probation officials looking into whether he violated the terms of his 2011 release from prison on a bank fraud conviction while making the film.

As a condition of his release, Nakoula, a Coptic Christian who most recently lived in the Los Angeles suburb of Cerritos, was barred from accessing the Internet or using aliases without the permission of a probation officer, court records show.

"The court has a lack of trust in the defendant at this time," Chief Magistrate Judge Suzanne Segal said in making the ruling, citing a pattern of deception and the possibility Nakoula was a flight risk.

The crudely made 13-minute movie, billed as a trailer, was filmed in California and circulated online under several titles including "Innocence of Muslims." It portrays the Prophet Mohammad as a fool and a sexual deviant.

On Sep. 11 and in the ensuing days, the clip sparked a torrent of anti-American unrest across the Muslim world. The outbreak of violence coincided with an attack on U.S. diplomatic facilities in the Libyan city of Benghazi that killed four Americans, including the U.S. Ambassador Christopher Stevens.

Federal probation officers investigating whether Nakoula, who was brought into the court wearing street clothes with his hands in cuffs and shackled at his waist, violated the terms of his release while making the film.

Federal prosecutors have made eight allegations against Nakoula of violating the terms of his release, including lying to probation officers. Nakoula's defense attorney had asked a federal judge in Los Angeles that he be given bond of $10,000.

Nakoula has stayed out of the public eye for much of the past two weeks, amid outrage in Muslim countries over the film. Last week, Pakistani Railways Minister Ghulam Ahmad Bilour offered $100,000 to anyone who kills the maker of the video.

The Pakistani prime minister's office later distanced itself from the railways minister's statement.

Nakoula's attorney, Steve Seiden, said on Thursday he was "extremely concerned for (Nakoula's) safety," suggesting he might not be safe in federal prison in Los Angeles because of the presence of Muslim prisoners there.

Prosecutors countered that Nakoula would actually be safer in custody than on the outside.

In an exclusive interview with NBC News' Ann Curry, Libyan President Mohamed Magarief says he has "no doubt" the attack on the U.S. Consulate in Benghazi was pre-planned.

Updated at 2:58 a.m. ET: An anti-Islam film that sparked violent protests in many countries had "nothing to do with" a deadly attack on the U.S. Consulate in Benghazi earlier this month, Libya's president told NBC News.

In an exclusive interview with NBC News' Ann Curry, President Mohamed Magarief discounted claims that the attack was in response to a movie produced in California and available on YouTube. He noted that the assault happened on Sept. 11 and that the video had been available for months before that.

"Reaction should have been, if it was genuine, should have been six months earlier. So it was postponed until the 11th of September," he said. "They chose this date, 11th of September to carry a certain message."

Magarief said there were no protesters at the site before the attack, which he noted came in two assaults, first with rocket-propelled grenades on the consulate, then with mortars at a safe house.

The attack took the lives of Ambassador Chris Stevens, as well as information management officer Sean Smith and security personnel Tyrone Woods and Glen Doherty.

Magarief told Curry that based on the accuracy of the assault, he believes the attackers must have had training and experience using the weapons.

Hilary Stevens, sister of Christopher Stevens, the U.S. Ambassador to Libya who died Tuesday during an attack on the U.S. consulate in Benghazi. In an interview with Rock Center Anchor Brian Williams, Stevens reflects on her brother's legacy and work.

"It's a pre-planned act of terrorism," he said, adding that the anti-Islam film had "nothing to do with this attack."

'A strong friend'
Magarief said that while Libyans appeared to be behind the attack that "these Libyans do not represent the Libyan people or Libyan population in any sense of the word."

He added: "We consider the United States as a friend, not only a friend, a strong friend, who stood with us in our moment of need."

More than 40 people have been questioned in connection with the incident, the Libyan leader told Curry.

He described Stevens as a "humble and very unique human being" and a "great friend of Libya."

Backlash: Protesting Libyans storm militant compound

The Obama administration initially maintained that the attacks were directly linked to protests over the film. Speaking on NBC's "Meet the Press" on Sept. 16, U.S. Ambassador to the United Nations Susan Rice said: "What happened in Benghazi was in fact initially a spontaneous reaction to what had just transpired hours before in Cairo, almost a copycat of the demonstrations against our facility in Cairo, prompted by the video."

Thousands of Libyans stormed the headquarters of an Islamist militia group in Benghazi Friday night in a deadly exchange. NBC's Ayman Mohyeldin reports.

However, White House Press Secretary Jay Carney last week said it was "self-evident that what happened in Benghazi was a terrorist attack."

Speaking before the United Nations General Assembly on Tuesday, President Barack Obama said: "There are no words that excuse the killing of innocent" people.

Nonpartisan reports probably aren't nonpartisan at all -- Every now and then, folks flip out and decry the end of civility (as if politicians didn't used to duel), denounce the greatest expansion of government power in history (as if those internment camps were summer camps), promise the "mother of all battles" (America: 2, Saddam: 0), or act like there's such a thing as a nonpartisan government agency. And then when it's revealed that the nonpartisan government researcher whose paper backs up the liberal tax agenda has actually donated thousands to Obama and the Democrats, everyone flips out. Well, maybe in a perfect world, at least. Because why on earth would an economic ideology that has ignored a century of failure admit it's got a few things rigged now? Somebody call Eric Holder -- he'll know what to do.
